A Comparison of Modern Schools of American Jurisprudence
Abstract
Just as foregoing youthful illusion in order to attain an adult perspective has often proved a difficult experience for the young, so in the history of sciences, the process of acquiring the outlook of maturity has been a task, indeed, it was not without strain that medicine renounced the incantation and the leech, and biology admitted its Darwinian assumptions to be an amusing callowness. Therefore, the steadfastness with which writers in the science of jurisprudence in America, cling to the assumptions of a bygone era is somewhat to be expected. However, as in other spheres of knowledge, this uncritical devotion to earlier traditions has not contributed to progress in the field.
