Recision and Adoption: A Study of Decisions to Rescind at the Spence-Chapin Adoption Service, New York

Alexandra Tesoro Miller, Fordham University

Abstract

The purpose of this study is to try to determine some of the correlates of the decision by parents to rescind Declaration and Surrenders. For our purposes, we will define a Declaration and Surrender as a legal document which transfers the legal custody of a child from the natural parent and/or parents to The Spence-Chapin Adoption Service. To rescind means to abrogate or cancel something. When a natural parent desires to rescind a Declaration and Surrender, she is asking that the legal custody of the child be returned to her from the agency. She is desirous of negating the Declaration and Surrender she signed. It is hoped that the information we gather from this research study will aid The Spence-Chapin Adoption Service in dealing with the phenomenon of recision.
